Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Utility Wallet website at utilitywallet.com and the related tools and services we provide (collectively, the “Service”). The Service is operated by B&Z Homes Inc. d/b/a Utility Wallet (“Utility Wallet,” “we,” “us,” or “our”). By accessing or using the Service, you (“you” or the “Renter”) agree to these Terms. If you do not agree, do not use the Service.
1) What Utility Wallet Is
Utility Wallet is a free tool that helps you discover the electricity, natural gas, water, internet, and other utility and telecom providers available at a given address, compare available options, and request setup of those services. Utility Wallet facilitates connections between you and third-party providers. We are not a utility, an internet service provider, a retail energy provider, or a telecom carrier, and we do not deliver any of those services ourselves.
2) Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and that you are authorized to provide it.
3) Informational Tool; No Guarantee
Provider availability, plans, pricing, fees, deposits, promotions, and service maps are determined by the providers and can change at any time without notice. Information shown through the Service is for general guidance and may not reflect the exact options, prices, or eligibility for your specific address. We do not guarantee savings, availability, eligibility, or any particular outcome. You are responsible for reviewing provider confirmations, plan terms, rates, and bills after service is requested or changed.
4) Related Agreements
Certain actions you take through the Service are governed by separate agreements that are presented to you at the point you take the action and take effect only if you affirmatively accept them. These include:
- the Letter of Authorization, which authorizes Utility Wallet to act as your agent to set up and manage your utility and telecom services;
- the SmartSwitch Terms, which govern optional provider switching; and
- the Credit Check Authorization, which governs submission of your Social Security Number to requested providers and soft credit checks.
In addition, the utility, telecom, internet, and retail energy providers you select impose their own terms, conditions, and pricing, which may be presented to you during the setup flow. To the extent a separate agreement conflicts with these Terms with respect to the specific action it governs, that separate agreement controls for that action.
5) Third-Party Providers and Services
Utility Wallet merely facilitates the connection between you and third-party providers. We do not provide the underlying services, and we do not control the terms, conditions, pricing, eligibility decisions, deposits, fees, or performance of services provided by those providers. All obligations related to a provider’s service rest between you and that provider. You agree that Utility Wallet is not liable for provider discrepancies, additional or changed costs, deposits, delays, outages, denials of service, or service-quality issues.
6) Fees and Commissions
Utility Wallet is free for renters to use. We may earn a commission or referral fee from some of the providers featured on or available through the Service. These arrangements do not add cost to you, and you remain responsible for any charges, deposits, and fees imposed by the providers you select.
7) Your Responsibilities and Acceptable Use
You are responsible for the accuracy and completeness of the information you provide, and we are not responsible for delays or changes in service provisioning that result from inaccurate or incomplete information. You agree not to misuse the Service, including by: providing false information or another person’s information without authorization; attempting to gain unauthorized access to the Service or its systems; interfering with or disrupting the Service; scraping, harvesting, or copying content except as permitted; or using the Service for any unlawful, fraudulent, or abusive purpose.
8) Intellectual Property
The Service, including its content, design, logos, and trademarks, is owned by Utility Wallet or its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent.
9) Third-Party Links and Sites
The Service may contain links to third-party websites, tools, or resources, including provider sites and our setup flow operated through our partners. We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Accessing third-party sites is at your own risk and subject to their terms.
10) Privacy
Your use of the Service is also described by our privacy practices. We use the information you provide to deliver and support the Service, connect you with the providers you request, comply with law, and prevent fraud, and we share information with providers and service partners only as reasonably necessary to perform the actions you request or to comply with legal obligations.
11) Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information provided through it is accurate, complete, or current.
12) Limitation of Liability
To the maximum extent permitted by law, Utility Wallet will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or to any provider’s acts or omissions. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
13) Indemnification
You agree to indemnify and hold harmless Utility Wallet and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
14) Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where applicable consumer-protection law requires otherwise. Before initiating any formal proceeding, you and Utility Wallet agree to attempt in good faith to resolve any dispute informally by contacting us at the email below. Where you have accepted the Letter of Authorization, the arbitration agreement and class action waiver in that document also govern disputes arising out of or relating to the services authorized under it. Nothing in these Terms limits non-waivable consumer rights or your right to bring matters to the attention of regulatory agencies.
15) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
