Read-only preview. No signature or authorization is collected on this page. You authorize Utility Wallet only by checking the Letter of Authorization checkbox in the online utility setup flow and submitting that form.

How You Authorize

You authorize Utility Wallet by checking the Letter of Authorization checkbox in the online utility setup flow and submitting the form. The checkbox is presented unchecked, and the form cannot be submitted unless you check it. Checking the box and submitting the form is your electronic authorization, as described in Section 7.

The Letter of Authorization link shown next to the checkbox opens this exact version of this document.

SmartSwitch (provider switching) and credit checks are not part of this authorization. Each is presented as its own separate, optional checkbox, also unchecked, and each takes effect only if you check it.

1) Parties

Customer/Resident (“Customer”): the person responsible for utility or telecom services at the service address provided in the online utility setup form.

Service Address: the residence or service location provided during signup.

Authorized Agent (“Utility Wallet”): B&Z Homes Inc. d/b/a Utility Wallet. Partner branding may appear in the customer experience, but the entity appointed as agent under this LOA is Utility Wallet.

2) Appointment of Agent and Scope

Customer appoints Utility Wallet as Customer’s authorized agent for the limited purpose of setting up and managing utility and telecom services at the service address. This authorization includes the authority to take the actions below when reasonably necessary to complete or support Customer’s requested utility or telecom setup.

Start, Stop, or Transfer Service. Schedule service start dates, stop dates, transfers, move-ins, move-outs, and other service changes in coordination with utility and telecom providers.

Contract Execution. Execute supply agreements, enrollment forms, terms of service, letters of agency, or other provider documents in Customer’s name and on Customer’s behalf when needed to establish, transfer, or manage service. Customer acknowledges that agreements executed by Utility Wallet under this LOA may create legal obligations between Customer and the selected provider.

Plan Selection. Select plan term, price type, rate option, renewable percentage, add-ons, billing preferences, and other provider terms on Customer’s behalf when needed to complete the requested utility or telecom setup.

Account and Data Access. Request and use Customer account history, interval data, billing records, account numbers, meter identifiers, ESI/ESID identifiers, service addresses, and similar information to enroll service, troubleshoot issues, and manage services.

Provider Communications. Contact utilities, retail providers, delivery utilities, telecom companies, brokers, verification vendors, and other relevant service providers on Customer’s behalf.

Delegation. Engage vetted subcontractors, vendors, or service partners to perform the actions described in this LOA. Utility Wallet remains responsible for compliance with this LOA.

3) Utility Data and Provider Communications

Customer authorizes current and former utility, retail energy, delivery utility, telecom, internet, and verification providers to disclose to Utility Wallet and its authorized service providers information reasonably necessary to perform the services authorized by this LOA. This may include service address, billing and payment history, usage and interval data, meter or ESI/ESID identifiers, provider account numbers, account status, contract terms, and enrollment records.

Customer authorizes Utility Wallet to receive, on Customer’s behalf, notices, confirmations, rate or plan change notifications, renewal notices, billing communications, compliance correspondence, and other account-related communications from utilities, telecom providers, and retail providers.

Relay of Material Communications. Utility Wallet will use commercially reasonable efforts to relay material provider communications — including contract renewal notices, rate or plan change notices, disconnection notices, and compliance correspondence that requires Customer action — to Customer within five (5) business days of receipt, using the app, email, or other contact methods on file.

Customer acknowledges that Utility Wallet is not responsible for delays caused by inaccurate contact information or by provider communication failures outside Utility Wallet’s control.

4) Customer Responsibilities and Disclosures

No Guaranteed Savings. Prices depend on usage, fees, provider eligibility, market conditions, and provider policies. Utility Wallet does not guarantee savings.

Fees, Deposits, and Provider Charges. Customer remains responsible for all provider charges, deposits, connection fees, early termination fees, late fees, and other provider-imposed charges.

Eligibility and Timing. Service dates and timing are subject to provider and utility rules, schedules, outages, holds, verification requirements, and other provider-controlled processes.

Accurate Information. Customer must provide accurate information and promptly update contact details, service address details, occupancy dates, and other information needed to complete service requests.

Customer Review. Customer is responsible for reviewing provider confirmations, plan terms, rates, bills, account notices, and service details after service is created or changed.

5) SmartSwitch Provider Switching Is Separate

This LOA does not, by itself, authorize Utility Wallet to enroll Customer with a different utility, telecom, internet, or retail energy provider for the purpose of changing providers after the initial setup.

Provider switching is governed exclusively by the SmartSwitch Terms (v2026-05-17), available at utilitywallet.com/smartswitch-terms/v2026-05-17, and requires a separate, affirmative SmartSwitch checkbox in the online flow. If Customer enables SmartSwitch, that separate consent is recorded separately from this LOA consent and may be revoked independently of this LOA.

6) Credit Check Consent Is Separate

This LOA does not, by itself, authorize Utility Wallet or any provider to run a credit check. If a utility or telecom provider requires a credit check to determine eligibility, deposit requirements, or plan availability, Customer will be presented with a separate credit-consent checkbox before submission.

When shown, the separate credit-consent checkbox will state that the check is a soft credit check with no impact to Customer’s credit score, unless a provider requires a different type of inquiry and that different requirement is separately disclosed and affirmatively accepted by Customer.

Utility Wallet will record whether the credit-consent checkbox was shown, whether it was checked, the exact credit-consent language shown, and the timestamp of any credit-consent action.

7) Electronic Authorization, E-SIGN Disclosures, and Records

Customer agrees that checking the Letter of Authorization checkbox and submitting the online utility setup form is an electronic authorization and has the same effect as a handwritten signature where permitted by law.

Consent to Electronic Records. By authorizing electronically, Customer consents to receive this LOA, related consents, and associated notices electronically. Customer may request a free paper copy of this LOA, or withdraw consent to electronic records for future transactions, by contacting Utility Wallet at the contact information below. Withdrawing electronic consent does not affect the validity of authorizations already given.

To access and retain electronic records, Customer needs a current web browser, an internet connection, a valid email address, and the ability to view and save PDF files.

Records. Utility Wallet may capture and retain evidence of authorization, including the LOA version, immutable LOA URL, LOA content hash, exact checkbox text shown, initial checkbox state, checkbox click timestamp, form submission timestamp, IP address, user agent, device or session identifiers, flow or partner identifier, service address, and archived screenshots or DOM captures of the consent screen.

These records may be used to confirm Customer authorization, support provider requests, respond to disputes, and comply with legal obligations. Authorization records will identify the exact LOA version and consent language shown to Customer at the time of submission.

8) Data Use and Privacy

Utility Wallet uses Customer data to deliver and support the services authorized by Customer, comply with law, prevent fraud, maintain records, troubleshoot provider issues, and improve service reliability. Data may be shared with utilities, retail providers, delivery utilities, telecom providers, verification providers, subcontractors, and customer support tools only as reasonably necessary to perform authorized actions or comply with legal obligations.

9) Duration and Revocation

This authorization, once submitted, stays in effect until revoked by Customer. Customer may revoke authorization at any time by notifying Utility Wallet through the app or at the contact information below. Revocation applies prospectively and may not stop provider actions already completed or already in progress before Utility Wallet receives and processes the revocation request. Revoking this LOA also terminates SmartSwitch, if enabled.

10) Jurisdictional Limits

This LOA applies only where permitted by law. Some jurisdictions or providers may require additional steps, third-party verification, wet signatures, direct Customer confirmation, or provider-specific authorization forms. Utility Wallet will not rely on this LOA where applicable law or provider rules require a different authorization process.

11) Liability

Except for willful misconduct or gross negligence, Utility Wallet is not liable for indirect, incidental, special, consequential, or punitive damages; provider outages; provider delays; provider pricing changes; provider denial of service; provider account obligations; or provider acts or omissions. Some jurisdictions do not allow certain limitations, so these limits apply only to the extent permitted by law.

12) Governing Law; Dispute Resolution; Class Action Waiver

Governing Law. This LOA is governed by the law of the state where the service address is located, unless applicable law requires otherwise.

Informal Resolution First. Before initiating any formal proceeding, Customer and Utility Wallet agree to attempt in good faith to resolve any dispute informally. The party raising the dispute will send a written notice describing the dispute and the requested resolution to the other party (for Utility Wallet, at the contact information below), and the parties will confer within sixty (60) days of the notice.

Binding Individual Arbitration. Any dispute, claim, or controversy arising out of or relating to this LOA or the services authorized under it that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The Federal Arbitration Act governs the interpretation and enforcement of this section. Utility Wallet will pay arbitration filing, administration, and arbitrator fees beyond the amount Customer would pay to file in small claims court.

Class Action Waiver. Customer and Utility Wallet agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the remainder of this section remains in effect.

Mass Filings. If twenty-five (25) or more similar arbitration demands are filed by or with the assistance of the same or coordinated counsel, the parties agree the demands will be resolved in staged proceedings: the parties will each select up to ten (10) demands as bellwether cases, and remaining demands will be tolled and will not be filed (and no fees will be due on them) until the bellwether cases conclude and the parties have mediated the remainder in good faith.

30-Day Opt-Out. Customer may opt out of this arbitration agreement and class action waiver by emailing Utility Wallet at the contact below within thirty (30) days of first providing authorization, stating Customer’s name, service address, and intent to opt out of arbitration. Opting out does not affect any other part of this LOA.

Jury Trial Waiver. To the extent any dispute proceeds in court rather than arbitration, each party knowingly and voluntarily waives its right to a trial by jury where such waiver is permitted by law. Nothing in this section limits non-waivable consumer rights or a party’s right to bring matters to the attention of regulatory agencies.

13) Changes to This LOA

Utility Wallet may update this LOA from time to time. Each revision, including corrections, receives a new version identifier and a new immutable URL; version identifiers are never reused. The version and date above identify the current terms. Material changes will be presented for review and new authorization where required. Customer authorization records will reference the version that was shown at the time of authorization.
